Türkiye Cumhuriyeti Hazine ve Maliye Bakanlığı Mali Suçları Araştırma Kurulu Başkanlığı
(MASAK) ile Birleşik Meksika Devletleri Maliye ve Kamu Kredileri Bakanlığı Mali
İstihbarat Birimi (FTU-MEXICO), bundan sonra “Mali İstihbarat Birimleri (MİB ler)” olarak
anılacaktır;
İşbirliği ve karşılıklı menfaat anlayışı içinde, ülkelerindeki yetkili makamlar tarafından
soruşturma ve kovuşturma başlatılması ile sonuçlanabilecek bilgi paylaşımı amacıyla şüpheli
karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanı hakkındaki analizlerin
kolaylaştırılmasını İSTEMEKTEDİR.
Bu amaçla MİB»ler, ilgili Egmont Grubu belgelerini, özellikle “Şartı”nı ve “Mali İstihbarat
Birimleri Arasında Bilgi Paylaşım Prensipleri”ni göz önünde bulundurarak ve her birinin
ulusal mevzuatı çerçevesinde aşağıdaki şekilde anlaşmaya varmışlardır.
Amaç
1. MİB”ler, şüphelenilen karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanına
ilişkin bilgilerin toplanması, geliştirilmesi ve analizinde ülkelerinin ulusal mevzuatlarına
uygun olarak işbirliği yapacaklardır.
2. MİB'ler, mütekabiliyet ilkesine dayalı olarak, mevcut veya elde edilebilir en geniş
kapsamdaki bilgileri kendiliğinden ya da talep üzerine serbestçe paylaşacaklardır. Örneğin
MİB'ler Şüpheli İşlem Bildirimleri(ŞİBY/Şüpheli Faaliyet Bildirimleri(ŞFB) ile kaynakları
ve yetkileri dahilindeki başka bilgileri paylaşacaktır.
3. MİB'ler, bu Mutabakat Muhtırasının yorumlanması ve uygulanmasının Egmont Grubu'nun
düzenlemeleri, özellikle “Şartı” ve “Mali İstihbarat Birimleri Arasında Bilgi Paylaşım
Prensipleri” ile tutarlı olmasını temin edeceklerdir. MİB'ler, bu Mutabakat Muhtırası
kapsamında olmayan ilave hususlarda bu düzenlemeleri dikkate alacaklardır.
4. Bu Mutabakat Muhtırası, MİB'ler arasındaki işbirliğinin arttırılması ve geliştirilmesi
amacıyla imzalanmış olup MİB'lerin Devletlerini uluslararası hukukta bağlayan
uluslararası bir anlaşma değildir. Bu Mutabakat Muhtirasının hiçbir hükmü, MİB'lerin
Devletleri için yasal haklar veya taahhütler meydana getirecek şekilde yorumlanamaz ve
uygulanamaz.
Talepte Bulunma
5. Taleplerin zamanında ve etkin bir şekilde yerine getirilebilmesi için MİB'ler taleplerinde
analizi yapılan olayın açıklaması ve talepte bulunulan ülke ile potansiyel bağlantısı gibi
bilgiler de dahil olmak üzere, gerçeklere dayalı bağlantılı bilgiler ile hukuki bilgilerin
verilmesi için en üst seviyede gayret sarf edeceklerdir. Ayrıca herhangi bir ivedilik
ihtiyacını da belirteceklerdir.
6. MİB'ler taleplerin gerekçelerini, talebin kimin adına gönderildiğini (eğer varsa) ve
mümkün olduğu ölçüde de talep edilen bilgilerin kullanılma amacını belirteceklerdir.
7. Talepte bulunulan MİB talep kapsamındaki bilgileri, talepte bulunan MİB)'in önceden yazılı
izni olmaksızın talepte yer almayan kişilere veya talepte belirtilmeyen amaçlarla
açıklamayacaktır.
Cevaplar
8. MİB”ler taleplerin alındığını bildirecek ve bu taleplere zamanında cevap vereceklerdir.
MİB/”ler talebe cevabın tam olarak verilmesinin gecikebileceği durumlarda geçici veya kısmi
cevap vermek için azami gayreti göstereceklerdir.
9. MİB'ler, talepte bulunan muadilleri adına araştırmaları yapacak ve bu araştırmalar
yurtiçinde yapılmışsa elde edebilecekleri bütün bilgileri vereceklerdir. MİB'ler özellikle
aşağıda belirtilen bilgileri vereceklerdir:
(a) Doğrudan veya dolaylı olarak erişim sağlanabilir veya elde edilebilir olması gereken
bütün bilgiler; bunlar özellikle, MİB'lerin kendi yurtiçi analizleri için elde etme
yetkisine sahip oldukları bilgileri kapsamaktadır ve
(b) MİB'lerin yurtiçinde doğrudan veya dolaylı olarak elde etme veya erişim sağlama
yetkisine sahip oldukları diğer her türlü bilgiler.
Bilgilerin Kullanılması ve Açıklanması
10. MİBler paylaşılan bilgileri sadece talep edilme veya verilme amaçları için
kullanacaklardır. Bilgilerin başka yetkili makamlara dağıtımı veya bu bilgilerin
başlangıçta üzerinde anlaşılan amaçlar dışında kullanılması, talepte bulunulan taraftan
önceden izin alınması şartına bağlı olacaktır.
11. Bilgilerin başka suretle kullanımı veya dağıtımı için gereken ön izin MİBler tarafından
ivedilikle ve mümkün olan en geniş ölçüde verilecektir. Bu ön izin talebi bilgiyi veren
MİB'in ülkesindeki karapara aklama ve terörizmin finansmanıyla mücadele
düzenlemelerinin uygulama alanı dışında kalmadığı, bir ceza soruşturmasına halel
getirmediği, bilgiyi veren MİB'in ülkesindeki gerçek veya tüzel kişilerin ya da söz
konusu MİB”in Devletinin yasal menfaatleri ile açık bir şekilde orantısız olmadığı ya da
bilgiyi veren MİB'in ulusal hukukunun temel ilkelerine uygun olduğu müddetçe
reddedilmeyecektir.
12. Ön izin vermenin reddedilmesi uygun bir şekilde gerekçelendirilecek ve açıklanacaktır ve
MİBler bilgi paylaşımının yetkili kolluk makamları ve savcılar tarafından
yapılabilmesini temin etmek amacıyla kullanılabilecek alternatif yolları (örneğin
karşılıklı adli yardımlaşma kanalları gibi) araştıracaklardır.
13. Eğer bir MİB, diğer MİB”den aldığı bilgileri açıklamasını gerektirecek yasal bir süreç ya
da işleme tabi olur ise, söz konusu sürece ya da işleme tabi olan MİB ivedi olarak diğer
MİB: bilgilendirecek ve bilginin daha fazla ifşa edilmesini sınırlandırmak için makul
gayreti gösterecektir.
Geri Bildirim
14. Talep üzerine ve mümkün olduğunda, MİB'ler verilen bilgiye dayalı olarak
gerçekleştirilen analiz sonuçlarının yanı sıra verilen bilginin kullanımına ilişkin olarak
yabancı muadillerine geri bildirim sağlayacaklardır.
Gizlilik
15. Mevcut Mutabakat Muhtırasının uygulanmasından elde edilen bilgiler gizlidir. Bilgiler
resmi gizliliğe tabidir ve asgari olarak bilgiyi alan MİB'in ulusal kaynaklarından elde
ettiği benzer bilgiler için ulusal mevzuatının öngördüğü aynı gizlilik içerisinde
korunacaktır.
Bilgi Talebinin Reddi
16. MİB/lerin özellikle aşağıdaki durumlarda yardımlaşma yükümlülüğü bulunmamaktadır:
(a) Talebe ilişkin olaylar hakkında hâlihazırda başlatılmış adli yargılamanın bulunması,
(b) Yardımlaşmanın talepte bulunulan MİB'in ulusal yasal sistemine veya ulusal
güvenliğine ya da uluslararası anlaşmalara aykırı olması.
Talepte bulunan MİB, bilgi talebinin reddine ilişkin olarak bilgilendirilecektir.
17. MİB'ler, yardım sağlanmasını aşağıdaki gerekçeleri i leri sürerek reddetmeyecektir:
(a) Talebin vergilemeye ait konuları da ihtiva ettiğinin değerlendirilmesi,
(b) Yasaların finansal kurumları veya finansal olmayan belirli iş ve meslekleri (talep edilen
ilgili bilginin yasal bir imtiyazın veya yasal bir mesleki gizliliğin uygulandığı
koşullarda tutulması haricinde) gizliliği veya güvenliği korumaya yükümlü tutması,
(c) Yardımın soruşturma, inceleme ya da adli yargılamayı engellemediği sürece, talepte
bulunulan MİB'in ülkesinde talep edilen bilgiye ilişkin devam eden bir soruşturma,
inceleme ya da adli takibatın bulunması,
(d) Talepte bulunan MİB'in niteliği ya da statüsünün (mülki, idari, kolluk makamı vs.)
muadilinden farklı olması,
(e) Talepte belirtilen olayın konuyla bağlantılı veya şüpheli olarak değerlendirilmemesi ya
da analiz aşamasında öncül suçun bilinmemesi.
İletişim ve Prosedürler
18. Bilgi paylaşımları güvenli bir şekilde ve güvenilir kanallar ya da mekanizmalar vasıtasıyla
yapılacaktır. Bu amaçla MİB'ler Egmont Güvenli Ağı'nı veya asgari olarak Egmont
Güvenli Ağı'nın sağladığına eşdeğer güvenlik, güvenilirlik ve etkililik seviyesi sağlayan
ve MİB”ler tarafından kabul edilen diğer yolları kullanacaklardır.
19. MİB'ler, bu Mutabakat Muhtırasının uygulanması amacı ile her bir ülkenin mevzuatına
uyumlu olarak kabul edilebilir iletişim prosedürleri için müşterek düzenleme yapacaklar
ve birbirleri ile istişarede bulunacaklardır.
20. MİB/ler arasındaki iletişim, mümkün olduğunca İngilizce dilinde gerçekleştirilecektir.
21. Mümkün olduğu ölçüde, tüm bilgi talepleri, bilgi taleplerine ilişkin cevaplar, bilgi
paylaşımları, bildirimler ve bu Mutabakat Muhtırasına uygun olarak verilen izinler yazılı
olarak yapılacaktır.
İşbirliğinin Geliştirilmesi
22. MİBbler, karapara aklama ve terörizmin finansmanının önlenmesi, tespiti ve
caydırılmasına ilişkin olarak aralarında işbirliği yapabilecekleri diğer alanları müzakere
edeceklerdir.
Değişiklikler
23. Bu Mutabakat Muhtırası karşılıklı rıza ile her zaman değiştirilebilir. MİB'ler
değişikliklere ilişkin onaylarını karşılıklı iletişim yoluyla bildirecek ve son bildirim
tarihinde yürürlüğe girecektir.
Fesih
24. Bu Mutabakat her zaman feshedilebilir. MİB”lerden biri, feshin yürürlüğe girme
tarihinden en az otuz (30) gün önce diğer MİB'e yazılı bildirimde bulunarak bu
Mutabakat Muhtırasını feshedebilir.
25. MİB'ler arasında paylaşılan bilgi. ve belgeler, bu Mutabakat Muhtırası feshedilse bile
MİB/lerin ulusal yasal sistemlerine uygun olarak mahremiyet, gizlilik ve koruma
hükümlerine tabi olmaya devam etmelidir.
Yürürlük Tarihi
26. MİB'ler bu Mutabakata ilişkin onaylarını karşılıklı iletişim yoluyla bildirecek ve son
bildirimin alındığı tarihte yürürlüğe girecektir.
Bu Mutabakat Muhtrası ..AMWXAZA..........'da 24.1021202 tarihinde ve
Çvded, de Höxiee. sda 0k./.08/2022 tarihinde eşit şekilde geçerli kabul edilen
İngilizce, İspanyolca ve Türkçe dillerinde iki orijinal nüsha olarak imzalanmıştır. Bu
Mutabakat Muhtırasının hükümlerinin yorumlanması ve/veya uygulanmasında uyuşmazlık
çıkması halinde İngilizce metin esas alınacaktır.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE MINISTRY OF TREASURY AND FINANCE, FINANCIAL CRIMES
INVESTIGATION BOARD OF THE REPUBLIC OF TURKEY
AND
THE MINISTRY OF FINANCE AND PUBLIC CREDİT OF THE UNITED MEXICAN
STATES TAROUGH THE FINANCIAL INTELLİGENCE UNIT CONCERNİNG
COOPERATION IN THE EXCHANGE OF FINANCIAL INTELLİGENCE RELATED
TO MONEY LAUNDERİNG, ASSOCIATED PREDICATE OFFENCES AND
TERRORISM FINANCING
The Ministry of Treasury and Finance, Financial Crimes Investigation Board (MASAK) of the
Republic of Turkey and the Ministry of Finance and Public Credit of the United Mexican States
through the Financial Intelligence Unit (FTU-MEXTCO), hereafter referred to as "the Financial
Intelligence Units (FTUs)";
DESİRE, in a spirit of cooperation and mutual interest, to facilitate the analysis concerming
cases of suspected money İaundering, associated predicate offences and terrorism financing,
with a view to disseminating information which may ultimately result in investigations and
prosecutions by competent authorities in their respective Countries;
To that end, having regard to the relevant documents of the Egmont Group, particulariy, the
“Charter” and the “Principles for Information Exchange between Financial Intelligence Units”
and within the framework of each FIUs domestic legislation, they have reached the following
understanding;
Objective
1. The FUs will cooperate in accordance with the national legislation of their respective
countries to assemble, develop and analyze information relevant to suspected money
laundering, associated predicate offences and terrorism financing.
2. The FIUs will freely exchange spontaneously or upon reguest the widest range of information
available or obtainable, based on reciprocity. The FIUs will provide for example: Suspicious
Transaction Reports (STRsY/Suspicious Activity Reports (SARs), and any other type of
information based on their respective sources and powers.
3. İn interpreting and implementing this Memorandum of Understanding (MOU) the FIUs will
ensure consistency with the provisions of the Egmont Group, particularly with the “Charter”
and the “Principles for Information Exchange between Financial Intelligence Units”. FIUs
will consider these provisions for any further issue which is not covered in this Memorandum.
4. This Memorandum is concluded with a view to enhancing and developing cooperation
between the FTUs and does not constitute an intemational agreement binding upon the States
of the FİUs under intermational law. No provision of this Memorandum will be interpreted
and implemented as creating legal rights or commitments for the State of the FIUs.
Making reguests
5. To enable a timely and efficient execution of the reguests, the FLUs will make their best efforts
to provide, in the reguests; relevant factual and legal information, including the description
of'the case being analyzed and the potential link with the country of the reguested counterpart.
They will also indicate any need for urgeney.
6. The FIUs will indicate the reasons for the reguests, the parties (if any) on behalf of whom
those are sent and, to the extent possible, the purpose for which the information will be used.
7. The reguested FIU will not disclose the information contained in the teguest for information
to parties or for purposes not identified in the reguest without the prior written consent of the
teguesting FIU.
Responses
8. The FIUs will acknowledge receipt of the reguests and will respond to such reguests in a
timely manner. FİUs will further use their best efforts to provide interim or partial Tesponses in
a timely manner in such cases where there may be a delay in providing a full response.
9. The FIUs will conduct gueries on behalf of the reguesting counterpart and provide all
information that they would be able to obtain if such gueries were carried out domesticaliy. In
particular, FTUs will provide:
(a) all information reguired to be accessible or obtainable directly or indirectly; this includes
in particular the information that FIUs have the power to obtain for their domestiç
analysis; and
(b) any other information which they have the power to obtain or access, directiy or
indirectiy, at the domestic level.
Use and Disclosure of Information
10. The FIUs will use the information exchanged only for the purpose for which it was sought
or provided. Any dissemination of the information to other authorities or any use of this
information beyond those originally approved will be subject to prior authorization by the
reguested counterpart.
11. The prior consent for further use or dissemination will be granted by the FIUs promptly and
to the largest extent possible. Such consent will not be refused unless this would fall beyond
the scope of application of the providing FIU's Anti-Money Laundering and Countering the
Financing of Terrorism provisions, could impair a criminal investigation, would be clearly
disproportionate to the legitimate interests of a natural or legal person or the State of the
providing FIU or would otherwise not be in accordance with fundamental principles of its
national law.
12. Any refusal to provide the prior consent will be appropriately motivated and explained and
the FIUs will explore alternative ways (e.g. through mutual legal assistance channels) to
ensure that the information exchanged can be used by competent law enforcement agencies
and prosecutols,
13. If a FIU is subject to legal process or proceedings that could reguire the disclosure of
information it has received from the other FİU, the FIU subject to such process or
proceedings will immediately notify the other FTU and make reasonable efforts to limit
further disclosure of the information.
Feedback
14. Upon reguest and whenever possible, FIUs will provide feedback to their foreign
counterparts on the use of'the information provided, as well as on the outcome of the analysis
conducted, based on the information provided.
Confidentiality
15. The information acguired in application of the present Memorandum is confidential, Tt is
subject to official secrecy and is protected by at least the same confidentiality as provided
by the national legislation of the receiving FIU for similar information from national sources,
Refusals
16. The FIUs will be under no obligation to give assistance, especialIy if;
(a) the judicial proceedings conceming the same facts as those related to the reguest have
already been initiated.
(b) the assistance would be contrary to the domestic legal system or to national security of
the country of reguested FIU or international agreements.
The reguesting FIU will be informed of the reason for refusal,
17. The FlÜs will not refuse to provide assistance on the grounds that:
(a) the reguest is also considered to involve fiscal matters;
(6) laws reguire financial institutions or designated non-financial businesses and professions
(except where the relevant information that is sought is held under circumstances where
legal privilege or legal professional secrecy applies) to maintain secrecy or
confidentiality;
(e) there is an inguiry, investigation or proceeding underway in the Country of the FIU
receiving the reguest, unless the assistance would impede that inguiry, investigation or
proceeding;
(d) the nature or status (civil, administrative, law enforcement etc.) of the reguesting FIU is
different to its counterpart;
(e) the case to which the reguest refers to is not considered relevant or suspicious or the
specific type of the predicate offence is not known in the analytical phase.
Communication and Procedures
18. Exchanges of information will take place in a secure way and through reliable channels or
mechanisms. To this end, the FIUs will use the Egmont Secure Web or other ways accepted
by the FİÜs that ensure levels of security, reliability and effectiveness at least eguivalent to
those of the Egmont Secure Web,
19. The FIUs will jointly arrange, consistent with the legislation of their respective countries,
for acceptable procedures of communication and will consult each other with the purpose of
implementing this Memorandum.
20. Communication between the FTÜs will as far as possible take place in English.
21. To the extent possible, all reguests for information, Tesponses to reguests for information,
exchange of information, notices, and consents provided pursuant to this Memorandum will
be in writing.
Further Cooperation
22. The FlUs will discuss other avenues of cooperation between them in the prevention,
detection and deterrence of money laundering and terorist financing.
Amendments
23. This Memorandum may be amended at any time by mutual consent. The FlUs will
communicate their approval of these amendments by exchange of communications and İt
will take effect on the date of the last notification.
Termination
24. This Memorandum is revocable at any time. Either FU may terminate this MOU by giving
written notice to the other FIU with at least thirty (30) days in advance of the effective date
of termination.
25. The information and documentation exchanged between the FTUs must stay subjected to the
provisions of confidentiality, classification and protection notwithstanding the termination
of this MOU and according to the domestic legal system of the FIUs.
Effective Day
26. The FIUs will communicate their approval of this Memorandum by exchange of
communications and it will take effect on the date of receipt of the last notification.

Mexiçe, Cih nm on .04/. O, /2022 in two original copies in English, Spanish and
Turkish languages which are considered egualiy valid. In case of divergence of interpretation
and/or application of provisions of this Memorandum, the English text will prevail.

(MASAK) de la Repüblica de Turgufa y la Secretaria de Hacienda y Credito Püblico de loş
Estados Unidos Mexicanos a traves de la Unidad de Tnteligencia Financiera (UIF -MEXICO), en
adelante denominados “las Unidades de Inteligencia Financiera (UIF)";
DESEANDO, en un espiritu de cooperacidn y reciprocidad, para facilitar el anâlisis de casos de
sospecha de lavado de dinero, delitos determinantes asociados y financiamiento del terrorismo,
con miras a difundir informaciön gue en ültima instancia puede resultar en investigaciones y
enjuiciamientos por parte de las autoridades competentes en sus respectivos paises;
Para tal efecto, teniendo en cuenta los documentos relevantes del Grupo Egmont, en particular,
la “Carta” y los “Principios para el Intercambio de Informaciön entre Unidades de İnteligencia
Financiera” y en el marco de la legislaciön interna de cada UİF, han İlegado al siguiente
entendimiento:
Objetivo
I. Las UIF cooperarân de conformidad con la legislaciön nacional de sus Tespectivos paises
para recopilar, desarrollar y analizar informaciön relevante sobre sospechas de lavado de
dinero, delitos determinantes asociados y financiamiento del terrorismo.
2. Las UTF intercambiarân libremente, espontâncamente o previa solicitud, la mâs amplia gama
de informaciön disponible u obtenible, con base en la reciprocidad. Las UTF proporcionarân,
por ejemplo: Reportes de Operaciones Sospechosas (ROSYReportes de Actividades
Sospechosas (RAS), y cualguler otro tipo de informaciön con base en suş respectivas fuentes
y facultades,
3. Alinterpretar e implementar este Memorando de Entendimiento (MdE), las UIF garantizarân
la consistencia con las disposiciones del Grupo Egmont, en particular con la “Carta” y los
“Principios para el Intercambio de Informaciön entre Unidades de İnteligencia Financiera”.
Las UİF considerarân estas disposiciones para cualguier otro asunto gue no este cubierto en
este Memorândum.
4. Este Memorando se concluye con el fin de reforzar y desarrollar la cooperaciön entre las ULF
yno constituye un acuerdo internacional vinculante para los Estados de las UTF en virtud del
derecho interacional. Ninguna disposiciön de este Memorando serâ interpretada e
implementada como la creaciön de derechos o compromisos legales para el Estado de las
UIF,
Solicitudes de Informacidn
5. Para permitir una ejecuciön oportuna y eficiente de las solicitudes, las UTF harân sus mejores
esfuerzos para proporcionar: informaciön de hecho y de derecho relevante, incluyendo la
descripciön del caso gue se analiza y el posible vinculo con el pais de la contraparte
solicitada, Esto incluye indicar cualguier necesidad de urgencia.
6. Las UTF indicarân los motivos de las solicitudes, las partes (si las hay) en nombre de las
cuales se envfan y, en la medida de lo posible, el propösito para el gue se utilizarâ la
informaciön.
7. La UTF gue realiza la solicitud no divulgarâ la informaciön contenida a partes o para fines no
identificados en la solicitud sin el consentimiento previo por escrito de la UIF gue
proporciona la informaciön.
Respuestas
8. Las UF acusarân recibo de las solicitudes y responderân a las mismas de manera oportuna.
Las UTF harân ademâs sus mejores esferzos para proporcionar respuestas provisionales O
parciales, de manera oportuna, en aguellos casos en los gue pueda haber un retraso en la
entrega de una respuesta completa.
9. Las UİF realizarân consultas en nombre de la contraparte solicitante proporcionarân toda
la informaciön gue podrian obtener si dichas consultas se realizaran a nivel nacional. En
particular, las UIF proporcionarân:
(a) toda la informaciön reguerida para ser accesible u obtenible directa o indirectamente; esto
incluye en particular la informaciön gue las UTF tienen el poder de obtener para su andlisis
intermo; Y
(b) cualguier otra informaciön a la gue tengan el poder de obtener o acceder, directa o
indirectamente, a nivel nacional.
Uso y Divulgaciön de la Informaciön
10. Las UIF utilizarân la informaciön intercambiada ünicamente para el propösito para el cual
fue solicitada o proporcionada. Cualguier divulgaciön de la informacidn a otras autoridades
o cualguler uso de esta informaciön mâs allâ de los originalmente aprobados estarâ sujeto a
la autorizaciön previa de la contraparte,
11. Las UF otorgarân el consentimiento previo para el posterior uso o difusiön de la informaciön
con la mayor brevedad y en la mayor medida posible. Dicho consentimiento no serâ
denegado a menos gue este mâs allâ del âmbito de aplicaciön de las disposiciones Anti-
Lavado de Dinero y Contra el Financiamiento al Tetrorismo de la UF proveedora, pueda
perjudicar una investigaciön penal, sea claramente desproporcionado con respecto a los
intereses legitimos de una persona fisica o juridica o del Estado de la UF proveedora o no
est en linea con los principios fundamentales de su legislaciön nacional.
12. Cualguler negativa a proporcionar el consentimiento previo se motivarâ y explicarâ
adecuadamente y las UF explorarân formas alternativas (p. ej., a traves de canales de
asistencia legal mutua) para garantizar gue la informaciön intercambiada pueda ser utilizada
por los organismos encargados de hacer cumplir la ley y los fiscales competentes.
13.Si una UİF estâ sujeta a procesos o procedimientos legales gue podrfan Teguerir la
divulgaciön de informaciön gue ha recibido de la otra UTF, la UTF sujeta a dicho proceso o
procedimientos notificarâ de inmediato a la otra UTF y harâ esfuerzos razonables para limitar
la divulgaciön adicional de la informaciön.
Retroalimentacidn
14. Previa solicitud y siempre gu sea posible, las UIF proporcionarân retroalimentaciön a sus
contrapartes extranjeras sobre el uso de la informaciön proporcionada, asi como sobre el
resultado del anâlisis realizado, con base en la informaciön proporcionada.
Confidencialidad
15.La informaciön adguirida en aplicaciön del presente Memorando es confidencial, Estâ sujeta
al secreto oficial y estâ protegida por al menos a misma confidencialidad gue la prevista por
la legislaciön nacional de la UTF receptora para informacidn similar de fuentes nacionales.
Rechazo de solicitudes
16.Las UF no estarân obligadas a prestar asistencia, especialmente si:
(a) ya se han iniciado los procedimientos judiciales relativos a los mismos hechos
relacionados con la solicitud.
(b) la asistencia es contraria al ordenamiento juridico interno o a la seguridad nacional del
pais de la UF gue recibe la solicitud o a acuerdos internacionales.
La UTF solicitante serâ informada del motivo de la denegacidn.
17.Las UİF no se negarân a prestar asistencia sobre la base de gue:
(a) se considera gue la solicitud tambi€n involucra asuntos fiscales;
(b) las leyes exigen gue las instituciones financicras o las actividades y profesiones no
financieras designadas (excepto cuando la informaciön relevante guc se busca se
mantenga en circunstancias en las gue se aplica el privilegio legal o el secreto profesional
legal) mantengan el secreto o la confidencialidad;
(c) hay una consulta, investigaciön o procedimiento en curso en el pais de la UIF gue recibe
la solicitud, a menos gue la asistencia impida dicha consulta, investigaciön O
procedimiento;
(d) la naturaleza o el estado (civil, administrativo, policial, etc.) de la UF solicitante es
diferente a su contraparte;
(e) el caso a gue se refiere la solicitud no se considera relevante o sospechoso o el tipo
especifico del delito determinante no se conoce en la fase analitica.
Comunicaciones y Procedimientos
18.Los intercambios de informaciön se realizarân de forma segura y a traves de canales o
mecanismos confiables. Para tal efecto, las ULF utilizarân la Red Segura de Egmont u otras
vias aceptadas por las UIF gue aseguren niveles de seguridad, confiabilidad y eficacia por lo
mehos eguivalentes a los de la Red Segura de Egmont.
19.Las UİF acordarân conjuntamente, de conformidad con la legislaciön de sus respectivos
paises, los procedimientos aceptables de comunicaciön y se consultarân entre si con el fin de
implementar este Memorândum.
20.La comunicaciön entre las UTF se realizarâ, en la medida de lo posible, en ingl&s.
21.En la medida de lo posible, todas las solicitudes de informaciön, las respuestas a las
solicitudes de informacidn, el intercambio de informaciön, las notificaciones y los
consentimientos proporcionados de conformidad con este Memorando se realizarân por
escrito.
Cooperacidn adicional
22.Las ULF discutirân otras vias de cooperaciön entre ellas en la prevenciön, detecciön y
disuasiön del lavado de dinero y el financiamiento del terrorismo.
Enmiendas
23.Este Memorando puede ser modificado en cualguler momento por consentimiento mutuo.
Las UİF comunicarân su aprobaciön a estas modificaciones mediante intercambio de
comunicaciones y entrarâ en vigencia a partir de la fecha de la ültima notificacidn.
Terminaciön
24. Este Memorando es revocable en cualguier momento. Cualguiera de las ULF puede rescindir
este MdE mediante notificaciön por escrito a la otra UTF con al menos treinta (30) dias de
anticipacidn a la fecha efectiva de rescisiön.
25.La informacidn y documentaciön intercambiada entre las UF deberâ guedar sujeta a las
disposiciones de confidencialidad, clasificaciön y protecciön no obstante la terminacidn de
este MdE y de acuerdo con el ordenamiento juridico interno de las UF.
Inicio de Aplicaciön
26.Las ULF comunicarân su aprobaciön del presente Memorando mediante intercambio de
comunicaciones y surtirâ efecto a partir de la fecha de recepciön de la ültima notificaciön.
Este Memorando O fue firmado en AÂWZAKA... el 24102..022 y en
Gudad. de, Mice, el 04/04 /2022 en tres copias originales en idiomas ingl&s,
espafol y turco gue se consideran igualmente vâlidas. En caso de divergencia de interpretaciön
yo aplicaciön de las disposiciones de este Memorândum, prevalecerâ el texto en ingles.
